In the case of home foreclosure, it is important to act in a timely manner, as there are strict timelines in place. If you miss payments on your mortgage:
- A creditor will file a motion for relief from the automatic stay on your mortgage foreclosure proceeding,
- The creditor will then file a notice of default, giving you 90 days to cure the default.
- If you do not cure the default within 90 days, the creditor will then file a notice of sale, giving you an additional 21 days to cure the default.
- If you miss that deadline, your home may be sold on the 21st day.
