What Is Conservatorship?
In California, a conservatorship is a court case where a judge appoints a person or an organization "the conservator" to care for an adult "the conservatee" who is unable to care for themselves or manage their own finances. Probate conservatorships are based on the laws of California's Probate Code, they include:
- General Conservatorships: For adults who cannot take care of themselves or their finances. Such conservatorships are usually for the elderly, but they are also used for younger people who are seriously injured or ill.
- Limited Conservatorships: These are for adults with developmental abilities who are unable to care for themselves or handle their finances. Conservatees may or may not require the level of care that is needed in a general conservatorship.
Two Types of Conservatorship
A judge will appoint either a conservator of the person, a conservator of the estate, or both, depending on the needs of the conservatee.
- Conservator of the Person: The conservator of the person is responsible for ensuring that the conservatee has proper food, clothing, shelter, and healthcare.
- Conservator of the Estate: In this situation, the conservator handles the conservatee's personal finances such as collecting the person's income and paying their bills.
It is important to note that being appointed a conservator of the person does not automatically make one a conservator of the estate. In order for one to be a conservator of the person and the estate, one must petition the court to be appointed as both.
